It's not quite that simple. It's pretty clear that booking the payment to Daniels as "legal fees" to Cohen constituted falsification of business records. The problem is that falsification of business records is only a misdemeanor in NY, unless the falsification was in connection with another crime, in which case it becomes a felony.
So what was the other crime? Arguably paying hush money was a campaign law violation of under NY law but this was a Federal election, so Federal law controls. Does falsification of business records in order to commit a Federal crime count for purposes of the NY statute? There are no cases either way. In any case, is paying hush money a "campaign donation"? Trump will testify that he did it in order to avoid family strife. Apparently when Melania found out she was really pissed as one might expect.
There are also statute of limitations issues and so on. With a little bit of luck, Trump's lawyers can delay the trial past the next election. Then if Trump wins, Bragg can try to put the POTUS on trial. Let's see the NYC cops shoot it out with the Secret Service. Should be fun. BTW, if Trump is convicted, does he get Secret Service protection in prison?

The question is not whether a crime was actually committed but whether Bragg has enough to bring this to trial and possibly even get a conviction before a biased judge and jury. Everyone here is arguing as if the facts actually mattered (and TBH, none of us really know all the facts anyway). As an "Ellis Island American", I mostly agree with this, with one important difference.
It wasn't so much that Anglo-America had more honest government and rule of law, as it was a culture which expected more 有限 government and laws. American elections circa 1800 were notoriously corrupt, as was administration of tariffs, but this does way less damage when it's just a much smaller part of life. As government encroaches on more and more of daily life, it often becomes less corrupt but more destructive as it destroys initiative, independence and any traditional sense of masculinity.

A lot of the various threads that have gone into America's decline are quite arguable. Is this or that bit of crazy, more because of the good-white Puritan tradition, because of Jewish ideology, simple coalitional politics catering to this or that group, finance/corporate globalism, because the rise of girl-power and cell phone social media ... or something else entirely. Lots of this is very arguable.
But the attack on genetics, on biological racial differences, on the relevance of IQ testing and all these HBD issues is one of the clearest cases. It was almost entirely a bunch of Jews attacking the actual science--empirically based--of a bunch of Anglos. With--as I said--plenty of outright lying (like Gould), lots of obfuscation (Lewontin) and just whole heaps of Jewish hysteric--"racist!" "Nazi!"--abuse, trying to shut down inquiry. That anyone can look at what happened and with a straight face, claim this anti-science attack wasn't primarily Jewish--in personel, ideology and argumentative style ... that's a person that has a problem with reality.

Our crowd was located further north closer to Lakewood/ Freehold. Vineland eggs mostly ended up in Philly and our eggs got eaten in NY. But otherwise a similar story.

He's the US intellectual father, as that word is used derisively because of all this fraud to destructive purposes, of the blank slate concept, which later "intellectuals" like Gould and Lewontin tried to place a biological gloss on. As I remember from the chapter, the 1920s was the decisive decade for this, which has to have helped set up a lot of the evil of the New Deal and of course that as followed by the Civil Rights Revolution and a new constitutional (dis-)order.

It's not quite that simple. It's pretty clear that booking the payment to Daniels as "legal fees" to Cohen constituted falsification of business records. The problem is that falsification of business records is only a misdemeanor in NY, unless the falsification was in connection with another crime, in which case it becomes a felony.
So what was the other crime? Arguably paying hush money was a campaign law violation of under NY law but this was a Federal election, so Federal law controls. Does falsification of business records in order to commit a Federal crime count for purposes of the NY statute? There are no cases either way. In any case, is paying hush money a "campaign donation"? Trump will testify that he did it in order to avoid family strife. Apparently when Melania found out she was really pissed as one might expect.
There are also statute of limitations issues and so on. With a little bit of luck, Trump's lawyers can delay the trial past the next election. Then if Trump wins, Bragg can try to put the POTUS on trial. Let's see the NYC cops shoot it out with the Secret Service. Should be fun. BTW, if Trump is convicted, does he get Secret Service protection in prison?

Clients, especially wealthy ones, pay their lawyers all the time to "handle things." And that's what this was, Trump reimbursing his lawyer for taking care of an extortion plot against him. That's fairly "legal fees" by any common sense understanding of reality.

It's not quite that simple. It's pretty clear that booking the payment to Daniels as "legal fees" to Cohen constituted falsification of business records. The problem is that falsification of business records is only a misdemeanor in NY, unless the falsification was in connection with another crime, in which case it becomes a felony.
So what was the other crime? Arguably paying hush money was a campaign law violation of under NY law but this was a Federal election, so Federal law controls. Does falsification of business records in order to commit a Federal crime count for purposes of the NY statute? There are no cases either way. In any case, is paying hush money a "campaign donation"? Trump will testify that he did it in order to avoid family strife. Apparently when Melania found out she was really pissed as one might expect.
There are also statute of limitations issues and so on. With a little bit of luck, Trump's lawyers can delay the trial past the next election. Then if Trump wins, Bragg can try to put the POTUS on trial. Let's see the NYC cops shoot it out with the Secret Service. Should be fun. BTW, if Trump is convicted, does he get Secret Service protection in prison?

It's not quite that simple. It's pretty clear that booking the payment to Daniels as "legal fees" to Cohen constituted falsification of business records. The problem is that falsification of business records is only a misdemeanor in NY, unless the falsification was in connection with another crime, in which case it becomes a felony.
So what was the other crime? Arguably paying hush money was a campaign law violation of under NY law but this was a Federal election, so Federal law controls. Does falsification of business records in order to commit a Federal crime count for purposes of the NY statute? There are no cases either way. In any case, is paying hush money a "campaign donation"? Trump will testify that he did it in order to avoid family strife. Apparently when Melania found out she was really pissed as one might expect.
There are also statute of limitations issues and so on. With a little bit of luck, Trump's lawyers can delay the trial past the next election. Then if Trump wins, Bragg can try to put the POTUS on trial. Let's see the NYC cops shoot it out with the Secret Service. Should be fun. BTW, if Trump is convicted, does he get Secret Service protection in prison?

A lot of the various threads that have gone into America's decline are quite arguable. The question is not whether a crime was actually committed but whether Bragg has enough to bring this to trial and possibly even get a conviction before a biased judge and jury. Let's say that your version of the facts is true - Cohen is just a total liar and there is no substance to the case at all. You burst into Bragg's office and breathlessly present your discoveries. "Alvin, this is all a bunch of BS. The statute of limitations has run out anyway. This whole case smells like a pile of poo. " Which does Alvin say to you: 1. Oh, thank you for letting me know that. As a prosecutor, I have a duty to dismiss this case immediately and I will draw up the necessary papers for dismissal." or 2. "You think I didn't f'ing know that?"

Bragg probably figures that, even with all the thumbs on the scale, he has maybe a 20% chance of conviction. That's not the point. The procedure is the punishment. Trump's name is dragged thru the mud. If he is the nominee and all the bad publicity is able to swing 5% of the voters, maybe even 1% of the voters, that's enough to win Biden a 2nd term.

You are missing my point. The question is not whether a crime was actually committed but whether Bragg has enough to bring this to trial and possibly even get a conviction before a biased judge and jury. Everyone here is arguing as if the facts actually mattered (and TBH, none of us really know all the facts anyway). Let's say that your version of the facts is true - Cohen is just a total liar and there is no substance to the case at all. You burst into Bragg's office and breathlessly present your discoveries. "Alvin, this is all a bunch of BS. The statute of limitations has run out anyway. This whole case smells like a pile of poo. " Which does Alvin say to you: 1. Oh, thank you for letting me know that. As a prosecutor, I have a duty to dismiss this case immediately and I will draw up the necessary papers for dismissal." or 2. "You think I didn't f'ing know that?"

Bragg probably figures that, even with all the thumbs on the scale, he has maybe a 20% chance of conviction. That's not the point. The procedure is the punishment. Trump's name is dragged thru the mud. If he is the nominee and all the bad publicity is able to swing 5% of the voters, maybe even 1% of the voters, that's enough to win Biden a 2nd term.
