My understanding is that elected representatives aren’t allowed to rake in speaking fees while in office. (They’re only allowed to collect six figures for speeches after they leave, which I’m sure makes a huge difference.) I’m not sure if this applies to judges, but if it does, SCOTUS might have missed out on the more lucrative rackets that legislators and presidents have enjoyed over the past 40 odd years. There has been a creeping infantilization of society for a while now. As a Gen Xer, for me it was pretty much assumed you’d move out of your parents house when you graduated high school, either to go off to college, or to get a job.
Go back a generation further, and no one would have batted an eye at a 22 year old deciding who she wanted to marry, even a much older man.
From a personal responsibility standpoint, society has moved backwards. Thank goodness, society has moved forward with regards to dental hygiene!

I had a writing teacher once who used to get pissed off that lawyers, legal opinions, and news reports about legal opinions would usually use the term “The Court” instead of the judge’s name who wrote or did anything.
He pointed out that this was a psychological trick to make people think of it as emanating from a reserved, detached, neutral, robotic, august institution instead of just people writing opinions. He said it caused reverence that shouldn’t exist. He urged us when writing about court actions to identify the judge by name and make them the people who did things, not The Court.
He said if more people just realized that judge’s were just politicians in robes we’d get a lot better kind of judges since we’d treat them as politicians and lobby them/castigate them/throw them out the same as we did for other pols, and we wouldn’t take their opinions as gospel but merely as political propaganda pieces. Naming the judge’s as the author of their actions instead of “the court” was the first step.
It wore a little thin by the time of Anna Nicole Smith and J. Howard Marshall. But as long as there are grossly rich old men and superficial gold diggers — which will be as long as humans exist, one way or another — we’ll get fresh examples.

Was trying to remember if I got this from our maestro (Steve) but I think it was in the recent Ken Burns VIETNAM WAR documentary.
Looked it up on Wikipedia and, yep, the rouge justice was Douglas, who had to be overruled by an emergency conclave of the other justices (including that rock-ribbed originalist Thurgood Marshall). So I think there was something else behind the opprobrium surrounding Douglas’s last marriage:

Nowadays, of the three liberal justices, only one has children, and the other two are barren. When Ketanji Brown Jackson takes her place on the Court she will be the only of the Courts three liberal women to have children (she has two) and she will up the number of Protestants to two. Some aspects of her bio – she is married to a white man, and an uncle was a police chief – provide me with some small (almost certainly futile) hope that she will be somewhat more conservative than the Left expects. And perhaps she will be swayed somewhat by Justice Thomas.
Well that changes everything! Those right-wingers are always slandering well-intentioned public servants – like Hillary Clinton and Joe Biden!

William O. Douglas served on the Supreme Court longer than any other justice. He stayed on well past his prime, even after his mental faculties had severely declined. He fell asleep during oral arguments and sometimes addressed people by the wrong name. The other Justices secretly agreed not to allow him to write any opinions or cast any decisive votes. If the other eight Justices were evenly divided on a particular case, they agreed to carry it over to the next term rather than allowing Douglas to decide it. His law clerks called him “shithead” (behind his back, of course).

Even if a 50+ man is physically attracted to a 20-something woman it’s going to be a difficult relationship simply because they’re going to have next to nothing in common. Their childhood and adolescent memories will be totally different, as will their preferences in basically all forms of entertainment and culture, and each one’s friends and same-age relatives will be way too old/young for the other. Even their political views are likely to differ: for example, the man will be greatly concerned with preserving Social Security and Medicare, while the woman could care less.
She was a waitress at a nice resort while she was in college. If she was working there looking for a husband it seems like she could have done better. Read the retirement section on Douglas’s Wikipedia page, she wasted her fertile years taking care of him and was too old to have kids when he died. It is reasonable to assume he would have been very difficult to deal with after he was forced off the Court and she most likely had to split whatever inheritance there was with his kids. Doesn’t sound like that great a deal to me.

I doubt there’s any way to prove it, but it’s entirely possible that John Tyler’s still-living grandson is the only person in the country who has a grandparent born in the 1700’s. Any other claimant would have to be a very elderly person whose father and grandfather both had children at ages decades past the normal age range at which men have children. You have to jump all the way forward to Herbert Hoover to find another President with a living grandchild.

His research indicated Douglas is hardly the only justice who’s stayed on past his sell-by date, and had clerks more or less act as shadow justices writing opinions for him.

Correct. St. Mary’s Law School in San Antonio (along with about 130 other American law schools) has a summer abroad program at their sister school in Innsbrook, Austria. The guest of honor was always a Supreme Court justice (it was Scalia the year I went). I don’t know what they paid them but it’s a pretty great perk to be treated like a god for the summer in the Alps. They spend the weekdays traveling around Europe and on the weekends have massive parties thrown for them at the home base in Innsbrook (fyi, Innsbrook is the most breathtakingly beautiful place I have ever seen in person…I paid for the law school loan-funded experience for ten years but it was the greatest summer of my life and money well spent).

I think Supreme Court justices should have a single 18 year term and get a million dollars per year salary and pension (so that retiring when they get sufficiently decrepit isn’t a burden) but that’s it.
I’d hardly call women in their 30s “young,” especially relative to men under 40. Old men can have all the 25+ girls they want. No skin off my 37 year old back.
Presifent Tyler was born in ’90 so that gives us a decade of wiggle room. But I would not bet against you. It would be a lot of work to calculate the odds pf your bet, but we could probably calculate what percentage of men born in the 1790s sired children past the age of 60 or 65. Then calculate the same for men born in the 1850s/1860s. Then account for the fact that a lot of the sons of the 1790s daddies never had kids, or had kids that died before today. Etc. A lot of data and work. But it is an interesting thing to think about.
I was born in 1984 and my dad in ’39. His dad in 1887 and his dad in ’40. Much shorter generation times than the Tylers, but much longer than most people. I’m sure I’m not the only American my age to have a civil war vet as a great grandpa, but I’d be surpised if there were more than 30. I’ve pretty sure I’ve never met anyone my age with a grandparent born before 1900.
I do think it’s sad my grandpa died before I was born even though he was very old when he died. And my dad never met his dad’s parents, unsurprisingly. And I’m fairly certain that my grandpa never met his dad’s parents, born around 1810. Long generations aren’t necessarily terrible (older parents tend to be more patient/wise and have more money than young parents), but I think the best situation would be to have short generation times combined with a supportive family that can help young parents with child rearing. Imagine growing up with most of your great-grandparents and some of your great-great-grandparents still around.
Douglas and Blackmun have very different personality profiles. But the commonality is that they both clearly demonstrate that America does not benefit by being ruled by these pompous wannabe philosopher kings.

— Have to return to posting on lower court and live out their days as an ordinary judge. Not allowed to go to private law practice again, nor be hired by anyone who had business before the court. (If they want to retire and fish–fine.)
— More judges (“justices”) to further de-royalize. 72 sounds pretty good.
— Case assignment by lot. Say 15 our of the pack (of 72?) are chosen. And granting cert and hearing the case are completely separate. Those granting cert are ineligible in drawing for those to hear a case. Or alternatively the “Supreme Court” in any case is simply a random drawing of judges from all the District Courts.

I suppose 15-20 million bucks a year for SCOTUS pay and pensions is a drop in the federal bucket, but controlling essentially 1/27th of the US federal government is more than enough compensation. Objectively I think conservative justices face a lot more danger than liberal ones, even though conservative Americans tend to be better armed, but obviously most liberals would disagree. And I’m sure all the liberal justices have had their fair share of death threats.
The irony is that Thomas and perhaps the other conservative judges (Roberts undoubtedly excluded) simply want to reduce the power of the federal government, thus making the role of the Supreme Court less important. But libtards can’t tolerate the idea of the federal government not controlling everything in this country in the way they want. The prospect of devolving power back to the states is just as outrageous to them as the prospect of conservatives having full control of an omnipotent federal government.
If libtards were intelligent and sane they would direct all their anger about our new status quo ante towards the Republican legislators in red states instead of the federal judges who have just returned power to state governments by overturning the worst legal decision since Dred Scott. I think that one of the great failures of the American experiment is that we attempted to mimic Ancient forms, such as democracy, but then grafted the English Common Law onto it. The Common Law was, even then, a poisonous and even quite malicious thing — and would be utterly reviled by the Ancients. The lesson in short: One mustn’t graft a diseased branch onto a healthy sapling.

When I was an undergrad many years ago, I attended a presentation that was put on by a recently minted history PhD, who had written his thesis on William O. Douglas. He told an interesting story about Douglas.
In one of Douglas’s books, he had described a mountain vista, overlooking a lake or something, that Douglas said he had climbed. Somewhere out west, maybe in California or Oregon. So the PHD fellow went to the same mountain and hiked the same trail himself.
When he got to the top, he realized that William O. Douglas’s description of it was radically different than what was actually there. From there, the PHD started double checking all of Douglas’s claims that were verifiable. He discovered that Douglas lied about his personal experiences basically continuously.

I’ve always felt that lifetime tenure with no accountability was a bad idea. Of course, when the Constitution was adopted, life expectancies were much shorter than today, but, even so, it needs to be changed. Only one Supreme Court Justice has ever been impeached, and he wasn’t convicted (although Abe Fortas resigned under threat of impeachment). Politicians of every stripe recognize that the Court functions as a second legislature that is not responsible to anyone.
I would propose an even more radical solution – elect them. There are nine US judicial districts, and so each one could elect one justice. Term limits would be mandatory. Term of office? Maybe six years, with one reelection, although this is debatable. Then out they go. Also, the number of Justices should be fixed by constitutional amendment – the current nine seems a good number. This would prevent the disgraceful (Democratic) attempts to pack the court.

Oliver Wendell Holmes, Jr. is considered one of the greatest Supreme Ct. justices and he served until he was 90. He did not go on the Court until he was 60. Some people become senile and others grow in wisdom. Some never have any wisdom to begin with.
Perhaps what is needed is a reconfirmation process once a justice hits say 75. Perhaps an independent medical commission to assess their mental and physical fitness. But of course in our highly partisan environment, it would be twisted for political purposes.

a. Many former SC decisions were later reversed. Roe v. Wade, Plessy v. Ferguson, etc. So a single SC decision doesn’t make some bad idea magically “constitutional.” That is the Woke mentality at work, fellows. Most of the worst ones get reversed eventually.

What we dance around here is that what made this seem reasonable was not an intelligence threat or contempt for law but a big weakness on our part. Nobody understood anything about Japan (after all, we didn’t think the surprise attack on Pearl Harbor could happen, and then we thought we could make them surrender by fighting them). Wrong, the weakness was letting a a minority study at Harvard without reciprocity. No US military or otherwise was studying at the Heigakko in the 1920’s.

Actually it was pretty comfortable for the Big Three. They had pricing power in the market and did not compete with each other on price, only on the size of the tail fins. I think judges make about \$200k (too lazy to look it up) and it may sound harsh, but that’s not a lot of money in a big city.
